If you manage a business or an organization in California, you may already know that your property must comply with the Americans with Disabilities Act, commonly abbreviated as the ADA. The ADA applies to any organization or business with a staff of at least 15 employees, any organization or business that benefits or relies on the public, and any federal, state, county, or local government agency. If My Parking Lot Violates the ADA, What Might Happen?

California has been known to be especially aggressive about ADA compliance. Under state law, all violations of the ADA are considered civil rights violations, and the minimum penalty is $4,000. This is in addition to attorney’s fees. Furthermore, California has its own requirements that supplement the ADA, and some of them are considerably more stringent. Because of the complexity of both the ADA and the state codes, it is imperative that you hire a contractor with a thorough understanding of all aspects that might apply to your property.

Are All Businesses Subject to the ADA?

There are few exemptions under the ADA. Private clubs, places of worship, and facilities operated or controlled by religious organizations are exempt from federal law. If you have fewer than 15 employees, you might not be subject to the ADA. If you do not use a building to conduct your business transactions, you may not be required to comply with ADA regulations. There are also certain situations that may qualify for a partial exemption. For example, if it is physically impossible to retrofit an existing building to provide an access ramp that fully complies with the ADA, you might qualify for a deviation on the ramp. However, it must be noted that you must still comply with all other points in the ADA if you can reasonably do so.
